Late Fees and Nonpayment, Handled Correctly

Maryland changed its late fee rules as recently as October 2025, and the failure-to-pay-rent process has specific steps that have to happen in order. Get any of it wrong and a judge can throw out the case.

Frequently Asked Questions

As of October 2025, a late fee can’t exceed 5% of the unpaid rent balance. If a tenant makes a partial payment, the fee has to be recalculated on what’s actually still owed, not the original full rent amount.
Not statewide. Maryland doesn’t set a default grace period, so a late fee can apply the day after the due date if the lease says so. We build clear, consistent late fee terms into every lease so there’s no ambiguity.
We send a written notice giving the tenant 10 days to pay the amount owed, which Maryland requires before a failure-to-pay-rent case can be filed in District Court. If it still isn’t resolved, we move to eviction coordination.
In most cases, yes. Maryland’s right of redemption lets a tenant remain in the property if they pay all rent due plus court costs before the sheriff acts. This doesn’t apply if the tenant has had three or more nonpayment judgments in the past 12 months.
