Rental rules in Allegany County
Whether you need a local rental license depends on the town the property is in.
- City of Cumberland: every rental unit needs a City rental license, $25 per unit per year on a July 1 to June 30 license year. A City code enforcement officer inspects before each new tenant moves in, unless the unit passed an inspection in the prior 12 months. Owners who do not live in Allegany County must appoint a local agent. (City of Cumberland)
- City of Frostburg: rental units are licensed every year, and the City’s rental housing inspector inspects each unit every three years. The FY27 fee is $48 per unit if renewed by February 1, rising after that. Owners who live more than 25 miles away need a local agent. (City of Frostburg)
- Unincorporated Allegany County (LaVale, Cresaptown, Bowling Green, Corriganville, Mount Savage): there is no county rental license. The county Livability Code sets minimum standards and is enforced when a tenant files a written complaint. (Allegany County Code ch. 375)
- Westernport: the Town’s published code includes an annual rental license, inspections at each change of tenant or every five years, and a local agent for owners outside Allegany County, but a state listing updated in 2026 shows no license. We confirm the current rule with the Town before your first tenant. (Westernport Town Code)
- Everywhere in Maryland: rentals built before 1978 must be registered with the Maryland Department of the Environment every year ($30 per unit, due December 31), and a passing lead inspection certificate is required before each new tenant moves in. (MDE)
- Security deposits: since October 1, 2024, Maryland caps a security deposit at one month’s rent, with a narrow exception tied to state utility assistance. It must be returned with interest and an itemized list within 45 days after the tenancy ends. (Md. Real Property 8-203)
